Terms of Service
These Terms govern the use of the Goutub service available at goutub.com (the "Service"). The Service is provided by DATALIT LLC (the "Provider"). By registering or paying for a subscription you (the "User") confirm that you have read and accept these Terms in full. The Terms constitute a public offer under Article 369 of the Civil Code of the Republic of Uzbekistan; registration or payment is acceptance of the offer.
1. Governing law
- Civil Code of the Republic of Uzbekistan.
- Law of the Republic of Uzbekistan "On Protection of Consumer Rights".
- Law of the Republic of Uzbekistan "On Electronic Commerce".
- Law of the Republic of Uzbekistan "On Personal Data" (ZRU-547).
- Other applicable legislation of the Republic of Uzbekistan, payment system rules and the YouTube API Services Terms.
2. The Service
The Service is a software platform that, from a topic provided by the User, automatically prepares video materials: script, voice-over, visuals, editing, thumbnails and description, and, on the User's instruction, uploads the finished video to the User's YouTube channel. The output is produced by artificial intelligence; the User reviews it before publishing.
3. Registration and account
- The User registers with a valid email address and is responsible for the accuracy of the data provided and for keeping the password safe.
- One account is intended for one User (or one organisation). Sharing access with third parties without the Provider's consent is not permitted.
- The User must be at least 18 years old or act with the consent of a legal representative.
- The Provider may suspend an account for a breach of these Terms, an attempt to bypass plan limits or suspected fraud, notifying the User by email.
4. Service description, plans and payment
- The service is access to the Service (a subscription) for the chosen period. The description, price, key characteristics and limits of each plan, and the terms of purchase, are listed on the pricing page goutub.com/price.
- Prices are set in the national currency of the Republic of Uzbekistan, the Uzbek soum (UZS), and are not pegged to any foreign currency. Charges are made in soums. For visitors from abroad the English version of the site may show an indicative amount in US dollars, which is not a price. The final amount is shown on the payment page before the payment is confirmed.
- Payment methods: Visa, Mastercard, Uzcard, Humo bank cards through the payment gateway of Ipak Yuli Bank. Card details are entered on the bank's secure page and are never passed to the Provider. For cards issued outside the Republic of Uzbekistan, the issuing bank performs the currency conversion at its own rate.
- Payment procedure: the User selects a plan and period, confirms the order, is redirected to the bank's payment page and enters the card details. Once the payment is authorised, the subscription is activated automatically and a confirmation is sent to the User's email.
- Subscriptions are paid in advance for the chosen period (month or year). There are no automatic charges: each period is paid separately by the User's action.
- If a payment method is temporarily unavailable, the Provider may activate a subscription upon the User's request to support after payment is confirmed.
- The Provider may change prices and plan contents; new prices apply to periods paid after the change.
5. Service delivery
The service is provided remotely in electronic form; nothing is shipped physically, and the cost of providing access is included in the plan price. Access to the paid plan is opened in the User's account automatically within minutes after the bank confirms the payment; with manual activation, within one business day. The service is available in any region with Internet access.
6. User's rights and obligations
- Use the Service only for lawful purposes and not infringe third-party rights, including copyright and image rights.
- Not create materials that violate the legislation of the Republic of Uzbekistan, YouTube's rules or the community guidelines of the platforms where they are published.
- Verify the factual accuracy of generated materials before publishing.
- Not attempt unauthorised access to the Service, disrupt its operation or bypass technical restrictions.
7. Provider's rights and obligations
- Keep the Service running as described on the pricing page; scheduled maintenance is announced on the site or by email.
- The Provider may change the Service's functionality, improve models and the interface without reducing paid limits.
- The Provider may remove materials that breach these Terms and block offending accounts.
8. Liability
The Service is provided "as is". The Provider does not guarantee monetisation, view growth or channel approval by YouTube. The Provider's liability is limited to the amount paid by the User for the current paid period. The Provider is not liable for the content of materials created at the User's request or for the actions of third parties (YouTube, payment systems, AI model vendors).
9. Intellectual property
Rights to the Goutub code, interface and trademarks belong to the Provider. Rights to materials created by the Service at the User's request pass to the User once generated, to the extent permitted by law and by the terms of AI model vendors. The User warrants that they hold the rights to any materials they upload (texts, images, voice samples).
10. Personal data
Personal data is processed in accordance with the Privacy Policy. Data is processed on the Provider's servers located in the Kyrgyz Republic under the cross-border transfer terms described in the Policy; by accepting these Terms the User consents to that transfer.
11. YouTube API Services
Publishing and statistics features use YouTube API Services. By connecting a channel the User accepts the YouTube Terms of Service and the Google Privacy Policy. Access can be revoked at any time in the Google account settings: myaccount.google.com/permissions.
12. Disputes
The parties will seek to resolve disputes by negotiation via support@goutub.com; the response time is up to 10 business days. Failing agreement, the dispute is referred to the court at the Provider's location in accordance with the legislation of the Republic of Uzbekistan.
13. Changes to the Terms
The Provider may amend these Terms by publishing a new version on this page with its date. Users are notified of material changes by email. Continued use of the Service after publication constitutes acceptance of the new version.
14. Refunds
- Full refund: if within 14 calendar days of payment the User has not used the Service (no video build was started), or if within 7 days of payment the Service could not produce a single video due to the Provider's fault.
- Partial refund: in all other cases the unused part of the paid period is refunded pro rata, less the limits actually used.
- Procedure: send a request to support@goutub.com from the account's email address, stating the payment date and amount. Requests are reviewed within 5 business days.
- Refunds are issued by the same method used for payment (to the same bank card) within 10 business days after confirmation; the time until the funds arrive depends on the issuing bank.
- No refund is possible: for a fully used paid period; for materials already generated and downloaded or published by the User; where the account was blocked for breach of these Terms; for payments made more than 12 months ago.
